Fast Probate Overview

“Probate” simply put is a document issued by the Supreme Court that proves the Will. The document has the court’s official seal, and names the Executor as the person who has authority to deal with the estate.

To obtain Probate, you must prove to the Court that the person named in the Will is deceased, the Will filed with the Court is the last valid will of the deceased person and that you are the Executor named in the Will.

To do this, the Court requires affidavits verifying these details. Affidavits are sworn statements.

It is not necessary in all cases to obtain Probate. You can administer the estate in accordance with a will without Probate, but if the will you possess is later found not to be valid or there is a later will signed by the deceased, then you as executor will be personally liable to the true beneficiaries for the value distributed wrongly. If you have obtained Probate you will not be liable.

If the deceased died “intestate” or without leaving a valid will, the court will issue “Letters of Administration” instead of a Grant of Probate. Letters of Administration have the same effect as Probate.

The Time Frame

The time frame to obtain Probate is about 3 months. Firstly, the Death Certificate is required to be obtained, which usually takes about 1 month to be issued. Then, we place the advertisements required by the court which include a 14-day public notice period to expire. We then prepare and have signed the necessary documents for signature and filing in the Supreme Court. The assessment by the court prior to issuing the Probate document takes around 1 month.
