Probate & Letters of Administration
Probate
Certainty for executors. Security for beneficiaries.
A Grant of Probate is the legal document that confirms a Will is valid and gives the executor authority to administer the estate.
In Queensland, Probate is issued by the Supreme Court of Queensland. In NSW, Probate is issued by the Supreme Court of New South Wales.
While Probate is not required in every estate, many financial institutions and asset holders will require it before releasing funds or transferring assets. Determining whether Probate is necessary can depend on the nature and value of the assets involved.
We guide executors across the Gold Coast through the Probate process, ensuring all requirements are met correctly and efficiently, reducing delays and providing clarity during what can be a complex and unfamiliar process.
Why do I need Probate?
- It is the Supreme Court’s official recognition of the validity of the Will
- Authorises the executor to act
- Enables access to assets
- Protects the executor from personal liability
- Facilitates asset transfer as banks, financial institutions, and other organisations usually require probate before releasing significant assets
- Provides certainty for beneficiaries

letters of administration
No Will or no executor? We can guide you.
Where a named executor is unable or unwilling to act or where no executor is named at all, a Grant of Letters of Administration is required.
This process allows the Court to appoint an administrator to manage the estate in accordance with legal rules. It can be more complex than Probate, particularly where multiple parties are involved or where there is uncertainty about entitlements.
We assist in preparing and managing these applications, ensuring the process is handled correctly and that the estate is administered efficiently and in accordance with the law.
What do Letters of Administration do?
- Authorises a person to manage an estate
- Enable access to assets and institutions
- Ensure debts and liabilities are properly managed
- Facilitate lawful distribution of the estate
- Provide transparency and certainty
- Protects the estate from unauthorised dealings or claims
